Walk into any law chambers in Lagos, Abuja, Port Harcourt, or Kano. You'll almost certainly find a mix of stamps and seals on desks, in filing cabinets, or locked in secure drawers. To an outsider, these look like ordinary office tools. Within the legal profession, several of them carry real weight — for daily work, for evidence, and for professional standing. A few are even governed by rules that courts have contested within the last few months.

Stamps vs. Seals — The Distinction Still Matters in Legal Practice

An ink stamp leaves a visible mark using ink. An embossing seal creates a raised mark with no ink at all. Legal practice uses both, for different jobs. A firm's daily work runs on ink stamps. Its most formal proof needs — notarial acts, certifications — rely on properly made embossing seals. Get the wrong one made for the wrong job, and you've built a filing-cabinet problem, not a courtroom one. That's exactly the kind of mistake worth avoiding before a deadline, not during one.

Common Ink Stamps Found in Nigerian Law Firms

  • RECEIVED STAMP — used by chambers and registries to confirm receipt of letters, court papers, and client documents.
  • DISPATCH STAMP — records outgoing letters, court filings, and legal notices.
  • CONFIDENTIAL STAMP — used on private legal messages and sensitive client details.
  • CERTIFIED TRUE COPY STAMP — used where a chambers can certify document copies under the relevant rules. Most chambers get this made as a custom self-ink stamp.
  • PAID STAMP — common in accounts departments to show that invoices and fees have been settled.
  • FILED STAMP — used once a document has been properly filed away.
  • URGENT STAMP — flags matters with deadlines, injunctions, and time-sensitive filings.
  • WITHOUT PREJUDICE STAMP — used on settlement talks and negotiation letters.

The NBA Stamp and Seal: A Requirement That's Actively Being Contested Right Now

This is the part of this post we want to get exactly right. The legal position has genuinely shifted more than once in the past decade. It's shifting again as we publish this.

The rule comes from Rule 10 of the Rules of Professional Conduct for Legal Practitioners 2007, which said a lawyer acting as a legal practitioner "shall not sign or file a legal document unless there is affixed on such document a seal and stamp approved by the Nigerian Bar Association." This became compulsory from April 2015. On 27 October 2015, the Supreme Court, in APC v. General Bello Sarkin Yaki, upheld that it could be enforced. The Court held that a court process filed without the stamp is "improperly filed" (though not automatically void), and that the problem can be fixed by later affixing the approved stamp and seal. (See the NBA's own official statement reaffirming this position.)

Here's where it gets genuinely complicated. In September 2020, the Attorney-General of the Federation amended the RPC. This deleted Rule 10, along with several related rules, entirely. It removed the mandatory stamp-and-seal requirement. A later version, the Rules of Professional Conduct (RPC 2023), appears to have brought back similar rules — this time under Rules 11 and 12. These were later linked to Mandatory Continuing Professional Development (CPD) compliance, brought in in 2025. Then came a new ruling. In a judgment on Suit No. FHC/ABJ/CS/1238/2025, a Federal High Court in Abuja struck down the rules tying CPD compliance to the issuance of NBA stamps and seals and to a lawyer's right of audience in court. The Court ruled that the NBA cannot impose conditions beyond what the Legal Practitioners Act itself provides. The NBA has publicly disputed that this ruling invalidates the underlying stamp-and-seal regime. It points back to the 2015 Supreme Court decision as still-binding authority.

What this means practically: the core expectation — that a legal practitioner's court filings carry an approved seal and stamp — has deep roots and Supreme Court backing. But the exact current rules, and specifically whether stamp/seal issuance can be tied to CPD compliance, are live questions as of this writing. Any lawyer relying on this for an active filing should confirm the current position directly with the NBA rather than treating any single summary — including this one — as the final word.

When issued, the stamp typically shows the lawyer's name, Supreme Court enrolment number, year of call to the Bar, and NBA-issued security features. Only lawyers properly enrolled and holding a valid practising licence may use one. Using another lawyer's stamp without permission can count as professional misconduct. Depending on the circumstances, it can even be a criminal matter.

The NBA's Digital Stamp and Seal

Worth knowing if you haven't come across it yet. On 19 August 2024, the NBA launched a Digital Stamp and Seal, built on blockchain technology. It's accessible through a dedicated e-commerce portal. There's also a mobile verification app (Android and iOS) that lets anyone scan a document to confirm the stamp is genuine. It's designed to let lawyers — including those based outside Nigeria — endorse documents digitally. No printing, scanning, or posting physical copies needed. It ties into the wider push toward electronic court filing, already active in places like Lagos, Abuja, and Kaduna.

Loss or Theft of Legal Stamps

Law firms should report a missing professional stamp or seal to management right away. They should also report it to relevant authorities or professional bodies where appropriate. Keeping custody records — who holds the stamp, when it's used, on what — is good governance practice regardless of the stamp's exact current regulatory status.

Embossing Seals in Legal Practice

Embossing seals show up in legal work for notarial acts, certificate checks, certified copies, international papers, and company records. You'll find them anywhere a raised, ink-free, tamper-evident mark works better than an ink mark.

Notarial Seals: Now Under a Newer, More Digital Framework

Nigeria's notary rules got a big update in 2023. The Notaries Public Act, 2023, signed into law on 12 June 2023, repealed the older Notaries Public Act (Cap N141, LFN 2004). It brought in formal rules for electronic notarial acts. Here's how it works: a notary who registers their intention and digital signature with the Chief Registrar of the Supreme Court can now notarise documents remotely. This happens via audio-visual communication that meets specific identity-check standards. They're issued a separate digital seal, used only for those electronic acts.

Under the new Act, unauthorised practice as a notary — using the office, function, or seal of a notary without being properly on the register — is a criminal offence. Penalties have gone up a lot. The old Act's fine was largely symbolic. Now there's a much steeper daily penalty for continued violation, or imprisonment of at least four months. Forgery or unauthorised reproduction of a notarial seal is treated with equal seriousness.

Court Stamps

Court registries use their own official stamps for filing confirmation, payment checks, certified copies, court orders, and service endorsements. These stamps belong only to the judiciary. They should never be copied by anyone outside that office.

Corporate Legal Departments

In-house legal teams commonly use their own internal stamps: LEGAL REVIEWED, LEGAL APPROVED, COMPLIANCE VERIFIED, EXECUTION AUTHORISED. You'll find these at banks, oil companies, manufacturers, and government agencies. They work the same way internal office stamps do elsewhere in a business. They create a fast, visible record of where a document stands in an approval chain. But they carry extra weight, given the legal setting they sit in.

Digital Stamps in Modern Legal Practice

As Nigerian legal practice moves further into electronic work, more firms are adopting digital versions of their internal stamps too, for PDFs and electronic records. Two things are pushing this shift along: the NBA's own Digital Stamp and Seal, and electronic notarisation, now allowed under the Notaries Public Act 2023. The same strict security that applies to a physical stamp locked in a drawer needs to apply to its digital version too. That means access control, usage logs, and a clear internal policy on who can use it.

Ethical Guidelines for Legal Stamps and Seals

  • Never use a professional stamp without authority — this applies to NBA stamps, notarial seals, and internal firm stamps alike.
  • Keep stamps and seals under secure custody — limit access to approved staff only.
  • Keep usage logs where practical, especially for high-stakes stamps like CERTIFIED TRUE COPY or notarial seals.
  • Never copy court or government seals — this is treated as a serious matter, not a minor one.
  • Report loss or theft right away — to firm management and, where appropriate, the NBA or relevant authority.
  • Limit access to approved staff for every type of professional stamp in the office.
  • Protect digital versions from unapproved copying. A digital stamp file deserves the same custody rules as the physical one.

Getting Your Firm's Stamps Right

In the Nigerian legal profession, stamps and seals do more than office work. They support real proof, improve accountability, and — especially for NBA and notarial stamps — help preserve public trust in the justice system. The rules around the NBA stamp and seal have shifted a lot, even in the past year. It's worth checking with the NBA directly now and then, rather than assuming last year's rule still holds exactly as it did.

The regulatory status of the NBA Stamp and Seal regime described above reflects the position as understood at the time of writing and is subject to ongoing litigation and NBA policy — legal practitioners should confirm current requirements directly with the Nigerian Bar Association before relying on any summary, including this one, for an active filing.
